Liquidation Proceeding and Claims Process

On April 22, 2016, the Superintendent of Financial Services of the State of New York commenced a liquidation proceeding for Health Republic in the Supreme Court of the State of New York. Health Republic consented to the proceeding.

On May 10, 2016, a New York State Supreme Court judge approved a Liquidation Order that authorized the liquidation proceeding and appointed the Superintendent as the Liquidator. The Liquidation Order also directed the Liquidator to take possession and control of Health Republic’s property and assets and to liquidate Health Republic’s business and affairs in accordance with the New York Insurance Law. Providers should have submitted policy claims by March 31, 2016 in accordance with the procedures and deadlines set forth in the contracts governing their provision of services to Health Republic’s Members. Policy claims submitted in accordance with the relevant contractual requirements do not need to be re-submitted.

On September 15, 2016, the Supreme Court for the State of New York, New York County signed an order (the “Order to Show Cause”) setting October 11, 2016 at 10:00 a.m. as the date and time for any interested parties or their attorneys to show cause why an order approving certain procedures (the “Claims Adjudication Procedure”) for adjudicating claims for payment under Health Republic’s insurance policies (“Policy Claims”) should not be entered.

If you are a health care provider and have a Policy Claim against Health Republic, you should have submitted your Policy Claim in accordance with the deadlines and procedures set forth in the contract governing your provision of services to former members of Health Republic (your “Health Republic Contract”). If you already properly submitted a Policy Claim in accordance with the requirements of your Health Republic Contract, you do not need to re-submit it.
